The owner of the Online shop bioteq.ee (hereinafter the Online shop) is Talupargi OÜ (registry code 14049547), located in Karilepa village, Padise parish, Harju county 76006.
Validity of the sale contract, product and price information
The conditions of sale apply to purchasing the goods from the Online shop.
Information about the product is presented in the Online shop directly next to the product. The Online shop does its best to present the most accurate information as possible about the product, nevertheless, the product descriptions may not be exhaustive and may contain inadvertent errors.
The prices of the products sold in the Online shop are marked next to the products. The prices will not be supplemented by VAT.
The prices will be supplemented by the fee for the delivery of the goods. The delivery fee depends on the size of the order, the location of the buyer and the type of delivery. The delivery fee will be displayed to the buyer after filling the data fields required for completing the order.
Order handling and payment
To order the goods, the desired products should be added to the shopping cart. The content of the cart can be changed before placing the order, if wished so.
To complete the order, it is necessary to fill the required data fields and select the suitable type of delivery. Then the total amount of the fee with the delivery fee will be displayed to the screen. To place the order, it is necessary to confirm the acceptance of these conditions of sale and pay for the order.
The Online shop will immediately send the confirmation about the placed order and the invoice to the e-mail address provided while completing the order.
The order must be prepaid. Bank or credit card payment will be made available right after placing the order in the Online shop. In case of the payment via bank transfer, the invoice sent must be paid within the deadline. Orders which have not been payed, will be cancelled 1 (one) day after the payment deadline.
The contract shall enter into force from the moment the Online shop has received the amount payable.
The products displayed in the Online shop are generally in stock. If, however, it is not possible to deliver the ordered goods in connection with the termination of the goods or for any other reason, the buyer shall be informed at the earliest possibility and the money paid will be refunded (including the cost of delivery of the goods) immediately, but not later than within 14 days of the date of notification.
The goods are delivered to all countries.
Within Estonia, the Online shop will send the goods using the parcel machine services offered by Omniva (AS Eesti Post) or Itella SmartPOST OÜ or DPD parcel shipping service. The shipments can be followed in the track and trace section on the websites of Omniva https://www.omniva.ee/abi/jalgimine, Itella SmartPOST uus.smartpost.ee/saadetise-otsing and DPD https://www.dpd.com/ee.
The Online shop delivers the goods outside Estonia by using parcel shipping service.
The delivery costs shall be borne by the buyer and the information about the prices is displayed next to the type of delivery.
Local shipments will usually reach the destination provided by the buyer within 3-7 working days since the entry into force of the sale contract. Outside Estonia, the delivery depends on the destination is maximum within 6 calendar days.
In exceptional cases the Online shop shall have the right to deliver the goods for up to 45 calendar days.
Right of withdrawal
After the receipt of the goods, the buyer shall have the right to withdraw from the contract concluded in the Online shop within 14 days. The right of withdrawal shall not apply, if the buyer is a legal person.
To use the 14-day withdrawal right, the ordered goods cannot be handled in any other way than what is necessary to establish the nature, characteristics and functioning of the goods, as it is allowed to test the goods in the physical shop.
If the goods have been used for any other purpose than it is necessary to establish the nature, characteristics and functioning of the goods, or if it has marks of use or wear, then the Online shop shall have the right to lower the fee to be paid according to the decrease in the value of the goods.
To return the goods, it is necessary to submit the application for withdrawal and send it to the e-mail email@example.com no later than 14 days since the receipt of the goods.
The costs of returning the goods shall be borne by the buyer, except in cases where the reason for return is that the item to be returned does not conform with the order (for example, a wrong or defective item).
The buyer must return the goods within 14 days of submitting the application or present a certified statement that the goods are handed over to the transportation company within the aforementioned period.
The Online shop will return the buyer all fees received under the sale contract immediately, but not later than 14 days since the receipt of the application for withdrawal.
The Online shop may refuse to reimburse the payments until the subject-matter of the contract is returned to the shop or until the buyer has provided evidence that they have sent the goods, whichever occurs earlier.
If the buyer has explicitly selected a different way of delivery than the regular and cheapest way of delivery offered by the Online shop, the Online shop is not obliged to return the buyer the cost that exceeds the usual cost of the regular way of delivery.
The Online shop shall have the right to cancel the sales transaction and reclaim the buyer to return the goods if the price of goods in the Online shop is by the reason of a mistake marked significantly below the market price of the goods.
The right to submit a claim
The Online shop will be responsible for the non-compliance with the contract’s terms or defect of the goods sold to the buyer, which existed already at the time of delivery, and which will emerge within two years maximum since the delivery to the buyer. Within the first six months since the delivery to the buyer, it is assumed that the defect existed already during the delivery. The obligation to rebut this assumption will be the obligation of the Online shop.
In case of the deficiency, the buyer shall have the right, within two months at the latest, to address the Online shop by sending the e-mail firstname.lastname@example.org or calling by phone: +372 5880 2781.
The Online shop shall not be responsible for any deficiencies that have arisen after the delivery of goods to the buyer.
In case the product purchased from the Online shop has any defects that the Online shop is responsible for, then the Online shop will repair or replace the product with a defect. If it is not possible to repair or replace the product, the Online shop will return all the fees arising from the sale contract.
The Online shop will reply to the complaint submitted by the consumer in writing or in the form which leaves a written record within 15 days.
Direct marketing and processing of personal data
The Online shop will use the personal data (incl. name, phone number, address, e-mail address, bank details) provided by the buyer only to process the order and payments and to send the goods to the buyer. The Online shop will transmit the personal data to the company providing the transport service to deliver the goods.
The Online shop will transmit the personal data to Maksekeskus AS (http://maksekeskus.ee/) to process the bank transfers and credit card payments. The Online shop shall not have the access to the data of the Client’s bank and credit card.
The Online shop will send the buyer the newsletters and offers to the buyer’s e-mail address only if the buyer has expressed this wish by entering the e-mail address on the website and has expressed their wish to receive direct marketing messages.
The buyer shall have the right to cancel e-mail newsletters and offers at any time by letting us know about it by e-mail or by following the instructions in the offers provided by e-mail.

In case the buyer and Online shop cannot resolve the dispute, the buyer will have a possibility to turn to the Commission for consumer disputes. The procedural requirements and a possibility to submit the application are available here. The Commission has the power to resolve the disputes arising from the contract concluded between the buyer and Online shop. The examination of the appeal by the buyer in the commission is free of charge.
The buyer may bring the complaint to the EU platform settling consumer disputes.
